Leave to agree the suit. In levying a fine to effect a conveyance of land, as soon as the action was brought, the defendant, knowing himself to be in the wrong, was supposed to make overtures of peace to the plaintiff, whereupon the plaintiff asked the court's leave to agree to a settlement or concord. See 2 Bl Comm 350.
