- A paradoxial expression. A prisoner, being under legal restraint, cannot acquire a domicil in his prison; his former domicil continues during his imprisonment. Likewise, where a prisoner is compelled to live within the liberties of the prison, he acquires no domicil there; his residence there is merely a continuation of his imprisonment. Nor would his desire to live within the prison make it his domicil. Wendel v Hoffman (DC NJ) 24 F Supp 63.
