Cujus est solum ejus est usque ad coelum
The owner of the soil owns to the sky. It has been held that this maxim is not strictly and absolutely applicable to all of the relations of the proprietors of adjoining lands. To apply it strictly in all cases would be to infringe upon that other maxim of the common law, "Sic utcre tuo ut alienum non laedas." Stillwater Water Co. v Farmer, 89 Minn 58, 93 NW 907.
