court not of record
An inferior court, or court of limited or special jurisdiction, such as the court held by a justice of the peace, a mayor, or other magistrate, and some city courts. The term "court not of record" is inexact and indifferent, so that in the absence of a statute declaring a court as one of record or not of record, difficulty is experienced in classification. A justice of the peace does keep a record of his judicial acts and of judgments rendered by him, even though he does not enroll them in an extended form. 20 Am J2d Cts § 26. Usually, the term "court not of record" has reference to a court of limited jurisdiction, negativing the idea that the court so described is one of general jurisdiction. 20 Am J2d Cts § 103.
