surrounding circumstances
The circumstances surrounding a transaction, an act, or an accident involved in an action or proceeding. The surrounding circumstances, which, in connection with the happening of an accident, may permit an inference of culpability on the part of defendant under the rule of res ipsa loquitur, refer, not to circumstances directly tending to show lack of care, but only to neutral matters of control and management by defendant which, when explained, may appear to be entirely consistent with due care.
