silence of Congress
A doctrine of frequent application in determining whether a state may enact regulations in a field of legislation in the absence of any direct expression of the will of the Federal Government, the rule being that when the subjects of a power are in their nature national or admit of one uniform system or plan, exclusive regulation by Congress is presumed to be required, and the failure of Congress to exercise the power of regulation is deemed to be an expression of its will that the subject should remain free from restrictions or impositions upon it by the several states. 16 Am J2d Const L § 209.
