Those persons on whom the law casts the real estate of a decedent or admits to participate in the distribution of his personal estate. 57 Am J1st Wills § 1371. Before the abolition of estates tail, the term was used to distinguish the preferred heir, to whom the estate was limited, from the heirs in general, but since such abolition, the term is equivalent to "heirs.” Brown v Wadsworth, 168 NY 225, 237, 61 NE 250.
