positive evidence
The testimony of an eyewitness. Commonwealth v Webster, 59 Mass (5 Cush) 295. Testimony to the affirmative of a proposition, that is, that a certain event did occur in the sight or hearing of the witness, as distinguished from testimony in the negative, that is, that the witness did not see or hear any such happening. 30 Am J2d Ev § 1092.
