physical fact rule
The principle that the testimony of a witness which is physically impossible and unbelievable, being irreconcilable with, or contrary to, physical facts and common observation and experience, is to be striken or disregarded as being without evidentiary value, even though uncontradicted by other evidence. 30 Am J2d Ev § 1085; 53 Am J1st Tr § 149. The principle that a reviewing court need not accept findings of fact which are inconsistent with well-known physical laws or with other facts or circumstances so well settled as to be the proper subject of judicial notice. 5 Am J2d A & E § 827.
