opposite party
An adversary in litigation. Under the statutory rule that when a suit is prosecuted by the heirs, assigns, devisees, legatees or personal representatives of a decedent, the opposite party, if he testifies on his own behalf, cannot testify to matters which, if true, must have been equally within the knowledge of the decedent, the term "opposite party" means the party in interest, the real party, and does not mean a defendant who is a mere nominal party such as an executor, who has no personal interest in the controversy.
