Modus de non decimando non valet
A modus or prescriptive exemption from the payment of tithes is not valid. This was the rule as to lay tenants, but spiritual persons or corporations, such as monasteries, abbots, bishops, and the like were always capable of having their lands totally discharged of tithes by various means.
