manifest impediment

manifest impediment
An impediment which operates to prevent a military court from exercising its jurisdiction over a soldier charged with a military offense. Such an impediment may consist of his being continuously a prisoner in the hands of the enemy, or of his being imprisoned under sentence of a civil court for crime, and the like.
