local improvement
A building or other work of construction, the cost and expense of which is chargeable upon private property by way of a special assessment. An improvement chargeable upon private property and possessing at least two essential elements: (1) It must be of a public nature, that is, it must be such an improvement as the municipality would be justified in constructing and maintaining by general taxation; and (2) it must confer a special benefit on the property sought to be specially charged with its creation and maintenance, over and above that conferred generally upon property within the municipality. Some courts have added a third element, that of permanency, denying the power of local assessment for an improvement of an evanescent type or nature. 48 Am J1st Spec A §§ 21 et seq.
