judgment of water

judgment of water
See judicium aquae. As used in a statute giving a right to a new trial in ejectment when the judgment is rendered on either default or verdict, it has been held that the term "judgment on a verdict" was intended to embrace all cases where the decision upon which the judgment was rendered had been given on contestation, as distinguished from a "judgment on default," and that such statute applies in cases where judgment is entered on the mandate of an appellate court. Smalles v Mitchell, 143 US 99, 36 L Ed 90, 12 S Ct 353.
