A judgment against a party taken upon his failure to plead. Graves v Cameron, Castles & Storey, 77 Tex 273, 275, 14 SW 59. Substantially the same as a judgment by default. Wilbur v Maynard, 6 Colo 483, 485; Stevens v State, 100 Vt 214, 136 A 387.
