In pari delicto potior est conditio defendentis
Where the parties are equally at fault, the defendant holds the stronger position. The general rule of the maxim applies not only to the original parties to an illegal, immoral or fraudulent transaction, but to their heirs, and to all parties claiming under them or by title derived from them, where no equitable rights intervene to protect such parties.
