implied condition
A condition which is not expressed but which is either implied by the law or by the common intention of the parties. As applied to estates in real property, a condition otherwise known as a condition in law, a condition which the law implies either from its being always understood to be annexed to certain estates, or as annexed to estates held under certain circumstances.
