A stipulation in an appeal bond, the effect of which may be to render the sureties liable upon dismissal of the appeal, even though the dismissal be erroneous, but not to render them liable where the writ of error is merely quashed for formal defect in the writ itself, since such would not be a disposal of the cause itself. 5 Am J2d A & E § 1031.
