grandfather clause
A clause in a licensing statute which exempts persons already engaged in the regulated business or occupation. Application of Richardson, 199 Okla 406, 24 P2d 642. A provision in a statute requiring a certificate of public convenience and necessity which excepts carriers currently operating. 13 Am J2d Car §§ 85, 86. The popular designation of a provision found in the constitutions of southern states exempting from property and literacy restrictions on suffrage descendants of persons voting before 1867, or descendants of persons who were in military service of the United States or the Confederate states in time of war.
