general instruction
An instruction by the court to the jury of such a nature that it is required, or at least proper, in all cases, for example, the charge that the jury shall consider only the evidence and the instructions given them by the court in arriving at a verdict. A charge to the jury in the form of an affirmative statement with a hypothesis, such being proper in some jurisdictions where there is no conflict in the evidence and where the facts testified to, if proved, entitle one party, plaintiff or defendant, to a verdict, the charge, in effect, stating that the jury shall find for such party if they believe the evidence or if they are satisfied that the facts are as testified. 53 Am J1st Trial § 550. A general charge in a criminal case is an instruction that the jury shall find the defendant guilty if they believe the evidence produced by the state, or, more properly, if they are satisfied beyond a reasonable doubt that the facts are as testified; such a verdict is never proper unless the evidence justifies a conviction and any other verdict would be inconsistent with the evidence as a whole. 53 Am J1st Trial § 551.
