agent and patient
A peculiar situation which arises where one is appointed by another to do or perform a thing for his own benefit, as where A appoints his creditor B to be his executor and A dies, whereupon B, acting in his capacity as executor, is authorized to pay the debt owing by A to him and acting in his own right, to receive it.
