As the ending of the period within which a case may be dismissed, or otherwise voluntarily terminated, without prejudice:-in a jury case, the moment when the court directs the jury to retire in charge of an officer for their consideration of the case, or to enter upon consideration of the case without retiring, 24 Am J2d Dism § 33; in a trial before the court without a jury, the moment when the court takes the case under advisement, the evidence having been presented, the arguments made, and the briefs filed. 24 Am J2d Dism § 34.
