ex post facto law
A law which, in its operation, makes that criminal which was not so at the time of the act, or which increases the punishment, or, in short, which, in relation to the offense or its consequences, alters the situation of a party to his disadvantage. Lindsey v Washington, 301 US 397, 81 L Ed 1182, 57 S Ct 797. A law that deprives a person accused of crime of a substantial right in which he was protected and granted immunity by the law in force at the time of the commission of the offense. Murphy v Commonwealth, 172 Mass 264, 52 NE 505. A law which operates upon a subject not liable to it at the time the law was made. State v Masino, 216 La 352, 43 So 2d 685, 14 ALR2d 720.
