equitable setoff
A remedy open to the defendant where, from the nature of the claim or the situation of the parties, it is impossible to obtain justice by plea or cross action-in other words, in those cases where, through no fault of the defendant, he has no adequate remedy at law. 20 Am J2d Countcl § 24.
