wilful default
A conscious abstention by an obligor from doing that which reasonably and under the terms of the obligation he should have done. Anno: 75 ALR 352. An intentional, although not necessarily malicious, wanton, or evil, failure to comply with a statute which prescribes the performance of an act intended for preservation of the safety of others. 35 Am J1st M & S § 213.
