A limitation or modification; a condition which limits. A quality that fits a person for a position. A condition prescribed either by constitutional provision or legislative enactment for hold ing public office. 42 Am J1st Pub Of §37. Competency to act in a particular capacity, such as executor or administrator. 31 Am J2d Ex & Act § 67. Taking an oath and providing a bond as conditions of acting in a particular capacity, for example, as executor or administrator. 31 Am J2d Ex & Ad §§ 106, 107. A technical term for the process of analyzing the nature of the question before the court for the purpose of determining the law applicable as between the laws of two or more jurisdictions. 16 Am J2d Confl L § 3.
