common-law mortgage
A feoffment on the condition that the feoffer might re-enter if he performed the condition of paying a certain sum of money on a certain date to the feoffee, the transaction also being known as dead pledge, because, upon nonperformance of the condition, the land was lost to the feoffer forever.
