cognizance of the cause
A term often invoked in determining priority of jurisdiction as between courts having concurrent jurisdiction, signifying that some step has been taken in a court in reference to a cause, such as the issuance of process, entertaining a motion, etc., so that the cause is pending. 20 Am J2d Cts § 136.
