coal and minerals

coal and minerals
A broad term, sometimes held to include oil and gas, where appearing in a deed or reservation in a deed. Gibson v Sellars (Ky) 252 SW2d 911, 37 ALR2d 1435. For practical purposes, the right to coal consists in the right to mine it. What makes the right to mine coal valuable is that it can be exercised with profit. A statute making it commercially impracticable to mine certain coal has very nearly the same effect for constitutional purposes as appropriating or destroying it. Pennsylvania Coal Co. v Mahon , 260 US 393, 67 L Ed 322, 43 S Ct 158, 28 ALR 1321.
