wilful trespasser
One who trespasses with knowledge that he is a trespasser. One who knowingly and wilfully encroaches or enters upon the land of another and takes his minerals without color or claim of right, or who dishonestly or in bad faith mines minerals of another and converts them to his own use, is a wilful trespasser; one who does so under color of right or in good faith by mistake is an innocent trespasser.
