voluntary statement
A statement by the accused in a criminal prosecution, proceeding from the spontaneous suggestion of his own mind, free from the influence of any extraneous disturbing cause. A reason why admissions by defendants are only admissible when voluntary is that they should be received with great caution. because they may not be true, for the mind of an accused, when oppressd by the calamity of his situation, is often influenced, by hope or fear, to make an untrue statement, when, as a matter of fact, the truth would be better.
