Transit terra cum onere

Transit terra cum onere
The land passes with its burden or encumbrance. The maxim presupposes a transfer of the land, and when that actually takes place, it forms the medium of a privity between the assignees. See Mygatt v Coe, 124 NY 212, 26 NE 611.
