stakeholder
One with whom money or property is deposited to abide the result of a gambling contract or transaction. Martin v Francis, 173 Ky 529, 191 SW 259. He is a mere depositary of both parties for the money deposited by them respectively, with a naked authority to deliver it over on the proposed contingency. If the authority is actually revoked before the money is paid over, it remains a naked deposit to the use of the depositor. The stakeholder is in no proper sense a party to the illegal contract, nor is he in pari delicto with the parties. Ball v Gilbert, 53 Mass (12 Met) 397, 402.
