special finding
An answer made by the jury to an interrogatory, being distinguished from a special verdict in the fact that it always accompanies a general verdict and further in the fact that it need not cover all the material issues. 53 Am J1st Trial § 1005. A finding of fact made by the court in a trial to the court. Not a mere report of the evidence, but a statement by the court of the ultimate facts on which the law of the case must determine the rights of the parties; a finding of the propositions of fact which the evidence establishes, and not the evidence on which those ultimate facts are supposed to rest, such finding having the same effect as the verdict of a jury.
