secret trust
A term frequently applied to any express or implied arrangement or understanding between a testator and a legatee whereby the latter is to take ostensibly as an ordinary legatee under the will of the testator, but is thereafter to apply the bequest or a part of it toward some charitable purpose; the real design of the bequest being to circumvent the statute limiting charitable bequests and devises. 15 Am J2d Char § 28.
