second deliverance
The remedy of a nonsuited plaintiff in replevin. In an action of replevin, the statute of Westin. II c 2 (1285), restrained a plaintiff, when nonsuited, from suing out a fresh replevin, but allowed him a writ of second deliverance by means of which he could again secure possession of the goods by giving security as before. See 3 Bl Comm 150.
