public corporation

public corporation
A municipal or political corporation. A corporation with political powers. Phillips v Baltimore, 110 Md 431, 72 A 902. A corporation created for public purposes only, connected with the administration of the government, the interests and franchises of which are the exclusive property and domain of the government itself. Dartmouth College v Woodward (US) 4 Wheat 518, 4 L Ed 629. A corporation may have a double aspect according to the nature of the powers granted and exercised. If they were granted and exercised for public purposes exclusively, they belong to the corporate body in its public, political, or municipal character. If the grant was for purposes of private advantage and emolument, though the public may derive a common benefit therefrom, the corporation, quoad hoc, is to be regarded as a private company. 18 Am J2d Corp § 8.
