partial eviction
An eviction of a tenant from a part of the premises. 32 Am J1st L & T § 480. To constitute a partial eviction which will operate as a suspension of rent, there must be either an actual expulsion of the tenant, or some act of a permanent character, done by the landlord with the intention and effect of depriving the tenant of the enjoyment of some part of the demised premises, to which he yields, abandoning possession within a reasonable time. Bartlett v Farrington, 120 Mass 284.
