Literally, in the course of a trial before court and jury or the court without a jury. In one sense, listed for trial, as where the case appears on the trial docket or calendar. The term as used in a statute providing that, whenever any criminal case shall be "on trial" at the end of any term, such term shall be continued until such case is finished, has been held to have its literal meaning, and requires that the case must be actually on trial before the court and jury at the end of the term.
