A defense worthy of a hearing or judicial inquiry, because raising a question of law deserving some investigation and discussion or a real controversy as to essential facts arising from conflicting or doubtful evidence, albeit not a perfect defense or defense assured of prevailing at a trial. 30A Am J Rev ed Judgm § 682.
