The common law doctrine that if a misdemeanor is an ingredient of a felony, the misdemeanor is an integral part of the felony and prosecution can only be for the felony. 21 Am J2d Crim L § 9. The embracing of one offense necessarily involved in another in the latter offense, for the purposes of determining the penalty upon conviction on a plea of guilty, for example, rape involving fornication, and robbery involving both assault and larceny. 21 Am J2d Crim L § 9. The doctrine that where an indictment charges more than one offense and the jury returns a general verdict of guilty, such verdict is understood to find the higher offense if there is testimony to support it.
