letter rogatory
A request by a court made of a foreign court in writing to secure the aid of the foreign court, backed by its power, in obtaining desired information in the form of a deposition by a person within the jurisdiction of the foreign court or to obtain the production of a record within the jurisdiction of such court. 23 Am J2d Dep § 23. While it is usual for a letter rogatory to be accompanied by written interrogatories, this is not essen- tial, unless required by statute; in the absence of any such statutory provision, the testimony may be taken upon oral examination. The absence of written interrogatories may, however, affect the question whether the court in its discretion will honor the letters. Anno: 9 ALR 967, s.108 ALR 384; 23 Am J2d Dep § 23.
