gift tax
An excise tax on the transfer by a living person of money or other property by gift. A tax imposed on the transfer of property by gift inter vivos without relation to the death of the donor, being distinguished from succession or estate taxes imposed on certain inter vivos transfers, such as gifts made in contemplation of death or intended to take effect in possession or enjoyment at or after death. The tax is imposed on the transfer, not on the property transferred, since it applies even though the property transferred may be exempt from income or other taxes. IRC § 2501(a).
