As a phrase expressive of the undertaking of the surety in a fidelity bond:–acts extending beyond those which are criminal; a phrase inclusive under a broad construction against a paid surety of acts and circumstances whereby loss is caused the obligee, even though not such as would support a criminal prosecution.
