feigned issue
An issue in a suit in equity presented for trial at law before a jury under the guise of a fictitious wager. 27 Am J2d Equity § 240. Feigned issues were also frequently used in courts of law, by consent of the parties, to determine some disputed right without the formality of pleading, thus saving time and expense. See 3 Bl Comm 452.
