Plainly seen or understood; manifest; obvious. Under a constitutional provision guaranteeing the right to bail except in capital cases when the proof is "evident," the word has been viewed as meaning manifest, plain, clear, obvious, apparent, and notorious. 8 Am J2d Bail § 50. In a more technical and precise sense, such probative facts as are requisite to prove ultimate facts. Ultimate facts are the facts which are pleaded and probative and evidentiary facts are those which supply the proof of the ultimate facts. 41 Am J1st Pl § 8.
