equitable construction

equitable construction
The construction of a statute by either restraining or enlarging the letter of the statute. Riggs v Palmer, 115 NY 506, 22 NE 188. The interpretation of instruments agreeably to and in conformity with the principles and rules of equity. By and large, the rules for the construction of a contract are the same in equity as in law. Neither a court of law nor a court of equity can interpolate in a contract what the contract does not contain either in words or by necessary implication. 17 Am J2d Contr §§ 241, 242.
