Dominus capitalis feodi loco haeredis habetur, quoties per defectum vet delictum extinguitur sanguis tenentis

The chief lord of the fee is regarded as heir whenever the blood of the tenant becomes extinct either through failure of heirs or attainder. See 2 Bl Comm 247.
