descent cast

descent cast
Literally, the devolving of title to real estate upon the heir upon the death of his ancestor intestate. A term used for the most part in designation of the acquisition of color of title by heirs where the ancestor, although possibly a trespasser originally, died in possession under claim of right. 3 Am J2d Adv P § 122.
