succession tax
An excise on the privilege of taking property by will, inheritance, or succession in any other form, upon the death of the owner. A tax upon the right to receive property from the estate of the decedent. McLaughlin v Green, 136 Conn 138, 69 A2d 289, 15 ALR2d 1210; Chase v Commissioner of Taxation, 226 Minn 521, 33 NW2d 706, 6 ALR2d 214. A tax imposed upon a legacy, devise, or distributive share of the estate of a decedent, not upon the estate. Re Rath, 10 Cal 2d 399, 75 P2d 509, 115 ALR 836; Re Daniels' Estate, 159 Ohio St 109, 50 Ohio Ops 79, 111 NE2d 252. Sometimes used loosely as inclusive of an estate tax on the theory that it is a duty or tax upon the transmission of a decedent's property, that is, his whole estate.
